Terms & Conditions for Courses, Tutor Support and Private Lessons

These Terms and Conditions apply to purchases from and use of Eureka Homeschool. Eureka Homeschool is a trading name of Boland Companies Ltd, a company registered in England and Wales under company number 11744949, whose registered office is at 1000 Lakeside North Harbour, Western Road, Portsmouth, United Kingdom, PO6 3EZ. Please read these Terms carefully before purchasing or using any course or service.

Where a Student is under 18 years old, the contract must be entered into by the Student's parent, legal guardian or another adult who is authorised to act on the Student's behalf.

Nothing in these Terms affects any statutory rights that a consumer is entitled to under applicable law.

1. Definitions

“Customer”, “you” or “your” means the adult who purchases the relevant Product and enters into the contract with us. Where the Student is under 18, this will normally be their parent or legal guardian.

“Student” means the named individual for whose personal educational use a Course, Tutor Support service or other educational Product is purchased.

“Eureka”, “we”, “us” or “our” means Boland Companies Ltd trading as Eureka Homeschool.

“Course” means an online self-study course, module or other digital educational programme supplied by Eureka.

“Tutor Support” means a Course package which includes tutor-marked assignments, feedback and limited email support as described on the relevant Product page.

“Private Lesson” means a separately booked individual tuition, consultation or similar appointment.

“SENCO Appointment” means a separately booked appointment relating to special educational needs, access arrangements or supporting evidence.

“Product” means any Course, Tutor Support package, Private Lesson, SENCO Appointment or other educational product or service offered by Eureka.

“Platform” means the website, learning management system or other technology through which Courses are delivered.

“Exam Board” means Pearson Edexcel, Cambridge International or any other awarding organisation relevant to a Course.

2. Scope of these Terms

2.1 These Terms apply to Eureka's online self-study Courses, Tutor Support Courses, Private Lessons, SENCO Appointments and other educational Products unless separate terms are expressly stated.

2.2 Examination entry is not included with a Course unless we expressly state otherwise in writing.

2.3 Pearson Edexcel Remote Invigilation examination bookings are subject to separate Eureka Homeschool Remote Invigilation Exam Booking Terms in addition to any applicable Pearson terms, rules and policies.

2.4 Where there is a conflict between these general Terms and specific written terms relating to a particular Product, the specific terms will apply to that Product to the extent of the conflict.

2.5 The relevant Product description, order confirmation and any specific terms referred to at checkout form part of the contract between you and Eureka.

3. Who may purchase from Eureka

3.1 A person purchasing a Product from Eureka must be aged 18 or over and legally capable of entering into a contract with us.

3.2 Where the Student is under 18, the Customer must be the Student's parent, legal guardian or another adult with appropriate authority to purchase the Product for the Student.

3.3 By placing an order for a Student under 18, you confirm that:

a. you are aged 18 or over;

b. you have authority to purchase the Product for the Student;

c. you accept these Terms on your own behalf as the Customer; and

d. you will take reasonable steps to ensure that the Student complies with the provisions of these Terms that apply to them.

3.4 A Student aged 18 or over may purchase a Product and contract directly with Eureka.

Purchases made by children

3.5 Eureka does not knowingly enter into contracts with children under 18.

3.6 If we become aware that a person under 18 has placed an order themselves, we may suspend access while we seek confirmation from an appropriate parent or guardian.

3.7 We may require the parent or guardian to confirm the purchase and expressly accept these Terms before access is restored or the order proceeds.

3.8 If the parent or guardian does not confirm the purchase, we may cancel the order and withdraw access. Any payment will then be dealt with in accordance with applicable law, the circumstances of the transaction and any applicable payment-provider rules.

3.9 A parent or guardian is not treated as having entered into a contract merely because a child has used their payment card or payment details without their permission.

4. Placing an order and formation of the contract

4.1 Product descriptions and prices displayed online are invitations to place an order.

4.2 When you place an order, you are offering to purchase the Product subject to these Terms.

4.3 A contract is formed when we accept the order and send confirmation or provide access to the relevant Product, subject to any additional adult-verification requirements under clause 3.

4.4 You are responsible for checking the order, Course title, Exam Board, qualification level, module and Student details before payment.

4.5 If we discover an obvious pricing, description or technical error, we may contact you to correct it. Where appropriate, you will be given the option to continue at the correct price or cancel for a refund.

5. Nature and purpose of Eureka Courses

5.1 Unless specifically stated otherwise, Eureka Courses are self-study educational preparation Courses.

5.2 Purchasing a Course does not constitute examination entry and does not itself result in the Student receiving an IGCSE, International GCSE, A Level, International A Level or any other formal qualification.

5.3 Formal qualifications are awarded by the relevant Exam Board following successful completion of its examination and assessment requirements.

5.4 Eureka designs its Courses to support preparation for the relevant syllabus or examination specification. However, no Course can guarantee that every learner will respond equally to every teaching method or resource.

5.5 Depending on the individual Student's prior knowledge, ability, learning style, educational needs and target grade, additional study, textbooks, practice, external resources or Private Lessons may be appropriate.

5.6 The Customer and Student remain responsible for deciding whether a particular Course, subject, syllabus and Exam Board are suitable for the Student's intended educational pathway.

6. No guarantee of examination results

6.1 Eureka does not guarantee:

a. any particular examination grade or mark;

b. that a Student will pass an examination;

c. admission to a particular school, college, university or other institution;

d. acceptance of a qualification by a particular institution, employer, country or authority; or

e. any particular academic, employment or career outcome.

6.2 Results depend on many factors outside Eureka's control, including the Student's ability, engagement, revision, attendance at examinations and performance under examination conditions.

6.3 Statements about preparation, progress, expected outcomes or the purpose of a Course must not be interpreted as a guarantee of a particular result.

7. Course specifications and changes

7.1 We aim to provide Course material that appropriately covers the intended qualification specification.

7.2 Exam Boards may amend specifications, assessment structures, permitted materials, examinations, subject availability or other requirements.

7.3 We may therefore update, reorganise, replace or amend Course content during the access period in order to:

a. reflect changes to a specification;

b. correct errors;

c. improve explanations or resources;

d. replace unavailable third-party material;

e. change technology providers; or

f. improve the Student experience.

7.4 Where an Exam Board makes a significant change or withdraws a qualification, we will use reasonable efforts to provide an appropriate update or alternative where reasonably practicable.

7.5 We welcome feedback regarding errors, broken links, unclear explanations or other Course issues. Please report these to helpdesk@myonlineteachers.co.uk. We aim to investigate and correct genuine issues promptly where reasonably possible.

8. Course access period

8.1 Unless a Product page expressly states otherwise, Course access is provided for 24 months from the date of purchase.

8.2 The 24-month period begins on the purchase date regardless of:

a. when the Student first logs in;

b. whether the Student uses the Course;

c. how frequently the Student studies;

d. any period during which the Student chooses not to study; or

e. whether the Student completes the Course.

8.3 Course access does not pause because of inactivity, holidays, changes in personal circumstances or voluntary breaks from study.

8.4 Course access expires automatically at the end of the 24-month access period.

8.5 Failure to complete the Course within the original access period does not create an entitlement to a refund or free extension.

Paid extensions

8.6 Eureka may offer Customers the opportunity to extend access after or towards the end of the original access period.

8.7 Where an extension is offered, the price will normally be 50% of the then-current selling price of the relevant Course.

8.8 The duration and other conditions of an extension will be stated when the extension is offered.

8.9 Extensions are subject to continued availability of the Course and are not an automatic contractual entitlement.

9. Course transfers

9.1 Eureka may, at its discretion, allow a Student to transfer from one Course or module to another.

9.2 Course transfers are not an automatic right.

9.3 Where a transfer is approved:

a. any additional price for the replacement Course must be paid;

b. where the replacement Course is cheaper, there is no automatic entitlement to a refund of the difference; and

c. the original 24-month access period continues and is not restarted or extended by the transfer.

9.4 We may refuse a transfer where it would be impractical, where substantial use has already been made of the original Product, or for another reasonable operational reason.

10. Student accounts and account security

10.1 Course access is licensed to one named Student only.

10.2 Parents or guardians may access the account where reasonably necessary to supervise or assist their own Student, but may not allow another Student to use the account.

10.3 Login credentials must not be shared with another household, learner, school, tutor, organisation or other third party for the purpose of giving another person Course access.

10.4 Customers and Students must take reasonable steps to keep usernames, passwords and other login information secure.

10.5 If we reasonably believe an account has been shared, compromised, sold, transferred or misused, we may temporarily suspend access while the matter is investigated.

10.6 Deliberate account sharing may result in permanent termination without a voluntary refund, subject always to the Customer's statutory rights.

11. Inactive accounts

11.1 For security purposes, Eureka may temporarily deactivate a Course account where the Student has not logged into it for three months or more.

11.2 Deactivation for inactivity does not cancel the Course and does not pause or extend the original 24-month access period.

11.3 Reactivation is normally free of charge.

11.4 To request reactivation, email helpdesk@myonlineteachers.co.uk.

11.5 We may ask for reasonable account or identity verification before restoring access.

12. Prices and payment

12.1 The price payable is the price shown at checkout at the time the order is placed, subject to correction of obvious errors.

12.2 Eureka does not currently offer recurring subscription Courses under these Terms. Unless expressly stated otherwise, purchases are one-off payments.

12.3 Promotional and sale prices may change and do not create an entitlement to a retrospective discount or refund for earlier purchases.

12.4 Payment must be successfully authorised before access is provided unless we expressly agree otherwise.

Chargebacks and disputed payments

12.5 If a payment is reversed, charged back or becomes overdue, we may suspend access while the payment dispute is investigated.

12.6 Fraudulent, abusive or unjustified chargebacks may result in suspension or termination of access.

12.7 Nothing in this clause prevents a Customer from raising a genuine payment dispute, exercising lawful chargeback rights or pursuing statutory remedies.

13. Immediate digital access and statutory cancellation rights

13.1 Courses contain digital content which is normally made available shortly after purchase.

13.2 Where required by law, our checkout will ask the Customer to expressly request immediate supply of the digital content before expiry of any statutory cancellation period and acknowledge the effect that immediate supply has on the statutory right to cancel.

13.3 Where the Customer gives the legally required consent and acknowledgement, the statutory right to cancel digital content may end when supply of that digital content begins.

13.4 This does not remove the separate Eureka 14-Day Course Guarantee in clause 14 and does not affect statutory rights relating to faulty, misdescribed or otherwise non-conforming digital content or services.

14. Eureka 14-Day Course Guarantee

14.1 In addition to statutory rights, Eureka offers a voluntary 14-Day Course Guarantee on eligible Course purchases.

14.2 A Customer may request cancellation and a refund under this guarantee where:

a. the request is received within 14 calendar days of the Course purchase; and

b. the learning Platform records that the Student has completed less than 20% of the Course when the cancellation request is received.

14.3 A Course showing exactly 20% completion or more does not qualify for the voluntary guarantee.

14.4 Platform progress records will be used to determine Course completion for this purpose.

14.5 Cancellation requests must be emailed to helpdesk@myonlineteachers.co.uk.

14.6 Approved refunds will normally be returned using the original payment method where reasonably possible.

14.7 After the 14-day period, or once 20% or more of the Course has been completed, no voluntary Course refund is available merely because:

a. the Student changes their mind;

b. the Course is no longer required;

c. the Student decides to attend a school or another provider;

d. the Student does not enjoy or engage with the Course;

e. the Student changes subject or Exam Board;

f. the Student does not complete the Course; or

g. the Customer later finds an alternative resource.

14.8 This voluntary guarantee does not limit any legal remedy available where a Product does not meet statutory requirements.

15. Tutor Support Courses

15.1 Tutor Support is an addition to self-study learning and is not an unlimited private tuition service.

15.2 Tutor Support Courses may include:

a. tutor-marked assignments linked to specified chapters or groups of Course content;

b. feedback on submitted work;

c. submission of specified past papers towards the end of the Course;

d. feedback on those past papers; and

e. limited email support with Course-related questions.

15.3 The exact number and nature of Tutor Support assignments will be stated in the relevant Course or Product description.

15.4 Unless otherwise stated, a piece of Tutor Support work may be submitted once for marking and may receive one further resubmission following feedback where permitted by the tutor.

15.5 Tutor Support remains available only during the applicable 24-month Course access period.

15.6 Small Course-related questions, clarification requests and pointers may be dealt with through email support.

15.7 Queries requiring substantial explanation, extended teaching, personalised instruction or detailed one-to-one work may require the Student to book a separately paid Private Lesson.

15.8 Tutor Support does not entitle the Student to unlimited correspondence or on-demand private tuition.

15.9 We aim to respond within a reasonable period but do not guarantee an immediate response.

15.10 We may replace or change the allocated tutor where reasonably necessary.

16. Private Lessons

16.1 Private Lessons are separately booked and charged services.

16.2 Unless different terms are clearly stated when booking:

a. a Private Lesson may be cancelled for a refund if cancellation is received at least 24 hours before the scheduled start time;

b. a request to reschedule may be made at least 6 hours before the scheduled start time; and

c. cancellation, non-attendance or a rescheduling request made later than these periods may result in the Lesson being treated as used and no refund or replacement Lesson being provided.

16.3 Where Eureka or the tutor cancels a Private Lesson and cannot provide the Lesson as booked, we will offer a reasonable alternative appointment or refund the affected Lesson.

16.4 A Student arriving late is not automatically entitled to an extension beyond the scheduled end time.

Recording Private Lessons

16.5 A Private Lesson may be recorded where this is requested at the start of the Lesson and agreed by Eureka or the tutor.

16.6 Any recording is subject to applicable privacy and data-protection requirements.

16.7 Customers and Students must not secretly record, publish or distribute a Lesson without permission.

17. SENCO and access-arrangement appointments

17.1 Where available, Customers may book a paid appointment with Eureka's SENCO or other appropriate specialist regarding potential examination access arrangements.

17.2 Unless otherwise stated, the cost of a SENCO appointment will be the same as the then-current price of a Private Lesson.

17.3 A SENCO appointment does not guarantee that an Exam Board will approve an access arrangement.

17.4 Access arrangements are governed by the rules, evidence requirements and deadlines of the relevant Exam Board or examination centre.

17.5 Customers are responsible for providing complete and accurate supporting evidence within the required timescale.

18. Third-party content and external links

18.1 Courses may include or link to material, websites, videos, software or services operated by third parties.

18.2 Rights in third-party material remain with the relevant owner.

18.3 We select and use external resources in good faith but do not continuously control third-party websites or content.

18.4 External content can change, move, become unavailable or, in rare cases, be compromised after a link was originally reviewed.

18.5 Parents and guardians are responsible for appropriately supervising children while they use the internet and follow external links.

18.6 Subject to applicable law, Eureka is not responsible for inappropriate, altered, hacked or otherwise harmful content appearing on a third-party service where that content is outside our reasonable control and we have exercised reasonable care in providing the Course.

18.7 Customers should report concerning, broken or inappropriate links to helpdesk@myonlineteachers.co.uk so that we can investigate them.

19. Third-party technology providers

19.1 We may use third-party providers for learning platforms, hosting, video calling, payments, email, assessment systems or other functions.

19.2 We may change a provider where reasonably necessary for technical, commercial, security or operational reasons.

19.3 We will use reasonable efforts to avoid materially reducing the service the Customer purchased.

19.4 We are not responsible for the independent acts, omissions or failures of third-party providers that are genuinely outside our reasonable control.

19.5 Nothing in this clause removes responsibility that the law requires Eureka itself to retain.

20. Platform availability and outages

20.1 We aim to make the Platform reasonably available but do not guarantee uninterrupted 24-hour access.

20.2 Access may be interrupted by maintenance, upgrades, security work, internet failure, third-party outages, technical problems or circumstances outside our reasonable control.

20.3 Temporary interruptions do not automatically entitle a Customer to a refund.

20.4 An outage lasting fewer than 14 consecutive days will not normally result in financial compensation or a refund solely because of that outage, unless applicable law requires otherwise.

20.5 Where there is a significant or prolonged loss of access, particularly where caused by a matter within our control, we may provide an appropriate remedy such as restored access, an access extension or another reasonable solution.

20.6 Eureka is not responsible for a Student's own internet connection, device compatibility, local network, software, power supply or other equipment.

21. Parent and guardian responsibilities

21.1 Parents and guardians remain responsible for the Student's day-to-day supervision and welfare.

21.2 In particular, the parent or guardian is responsible for:

a. providing appropriate internet supervision;

b. maintaining suitable parental controls where appropriate;

c. deciding what online resources are appropriate for their child;

d. providing suitable devices and internet connectivity;

e. monitoring the Student's study and progress; and

f. obtaining additional educational support where reasonably required.

21.3 Unless expressly agreed otherwise in writing, purchasing a Eureka Course does not transfer general parental responsibility for the Student to Eureka.

21.4 Purchasing a self-study Course does not itself discharge any legal obligations a parent may have regarding their child's education in the jurisdiction where they live.

22. Behaviour and communications

22.1 Students and Customers must communicate appropriately with Eureka staff and tutors.

22.2 The following behaviour is not acceptable:

a. threatening or abusive communications;

b. harassment;

c. discriminatory or hateful conduct;

d. sexual or otherwise inappropriate communications;

e. deliberate intimidation;

f. fraudulent conduct;

g. attempts to compromise Eureka's systems; or

h. behaviour which creates a safeguarding or safety concern.

22.3 Serious or repeated misconduct may result in communications being restricted or services being suspended or terminated.

22.4 Where termination results from a serious breach by the Customer or Student, no voluntary refund will normally be provided, subject to statutory rights.

23. Intellectual property and permitted use

23.1 Course access is provided for the named Student's personal educational use.

23.2 Students may download Course resources where the Platform provides a download function or where Eureka otherwise permits downloading.

23.3 Downloaded material may be retained and used by the Student for personal study, subject to any applicable third-party licence restrictions.

23.4 Customers and Students must not:

a. sell or commercially exploit Eureka Course access;

b. give another Student their login details;

c. sell access to a Course;

d. reproduce Eureka-owned material for commercial distribution; or

e. deliberately circumvent Platform security or access controls.

23.5 Third-party materials included or linked within Courses remain subject to the intellectual-property rights and licence terms of their respective owners.

24. Suspension and termination

24.1 We may temporarily suspend access where reasonably necessary to investigate:

a. account sharing;

b. a security concern;

c. suspected fraud;

d. a chargeback or reversed payment;

e. abusive conduct;

f. attempted unauthorised access to our systems;

g. serious intellectual-property misuse; or

h. another material breach of these Terms.

24.2 We may permanently terminate access following a serious or repeated material breach.

24.3 Where access is terminated because of the Customer's or Student's material breach, Eureka is not required to provide a voluntary refund for services already properly supplied, subject always to applicable consumer law.

24.4 Where Eureka permanently discontinues a paid Product for reasons unrelated to Customer breach before substantially providing what was purchased, we will provide an appropriate remedy as required by law and the circumstances.

25. Privacy and personal information

25.1 We process personal information in accordance with our Privacy Policy and applicable data-protection law.

25.2 Customers must provide accurate personal information and tell us if important contact information changes.

25.3 Where necessary to provide a purchased service, information may be shared with relevant technology providers, tutors, examination providers, awarding bodies or other organisations involved in delivering that service.

25.4 Where safeguarding concerns arise, information may be used or disclosed where reasonably necessary and lawful for safeguarding or legal purposes.

26. Complaints and feedback

26.1 We welcome constructive feedback and want Customers to tell us about errors, problems or concerns so that we can improve our Courses and services.

26.2 Complaints should initially be sent to helpdesk@myonlineteachers.co.uk.

26.3 We aim, where reasonably possible, to acknowledge a complaint within one week.

26.4 We aim, where reasonably possible, to investigate and provide a substantive resolution within one month.

26.5 More complex matters may take longer. Where possible, we will explain significant delays.

26.6 If the Customer is dissatisfied with the response, the complaint may be escalated to proprietor@bolandcompanies.co.uk.

26.7 Customers are encouraged to raise concerns about Course suitability during the 14-Day Course Guarantee where they wish to take advantage of that voluntary refund policy.

26.8 However, the expiry of the 14-Day Course Guarantee does not prevent a Customer reporting errors, providing feedback, making a complaint or exercising any statutory right that continues to apply.

27. Our responsibility to you

27.1 We will provide our services with the level of reasonable care and skill required by applicable law.

27.2 If we breach these Terms, we are responsible for loss or damage that is a reasonably foreseeable consequence of that breach or our failure to use reasonable care and skill.

27.3 We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.

27.4 Products are supplied to consumers for personal educational use. We are not responsible for business losses such as loss of profit, business interruption or loss of commercial opportunity arising from consumer use of the Products.

27.5 Subject to applicable law, Eureka is not responsible for loss arising solely from:

a. a Student's failure to study or engage with a Course;

b. a Student's examination performance or grade;

c. a Customer selecting an unsuitable subject, specification or qualification;

d. a Student requiring additional resources or tuition;

e. incorrect information provided by the Customer;

f. Customer or Student equipment or internet failure;

g. third-party material changing outside our reasonable control;

h. decisions made by an Exam Board, university, school, employer or other third party; or

i. a Customer's failure to supervise a child appropriately.

28. Liability that is not excluded

28.1 Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

28.2 In particular, nothing in these Terms excludes or restricts liability for:

a. death or personal injury caused by negligence where such liability cannot legally be excluded;

b. fraud or fraudulent misrepresentation;

c. statutory consumer rights which cannot legally be excluded or restricted; or

d. any other liability which applicable law does not permit us to exclude or restrict.

28.3 Nothing in these Terms removes the Customer's statutory rights relating to digital content or services that are required to be of the standard prescribed by law.

29. Events outside our reasonable control

29.1 Eureka will not be responsible for delay or failure caused by circumstances outside our reasonable control, provided that we act reasonably in responding to those circumstances.

29.2 These may include:

a. major internet or telecommunications failures;

b. failures of third-party platforms;

c. cyber incidents;

d. severe weather or natural disasters;

e. government restrictions;

f. strikes or industrial action;

g. Exam Board decisions;

h. withdrawal or alteration of qualifications;

i. examination cancellation; or

j. other events that could not reasonably have been prevented by Eureka.

29.3 Where such an event materially prevents performance, we will consider reasonable alternatives, extensions, rescheduling, credits or refunds where appropriate or legally required.

30. Changes to these Terms

30.1 We may update these Terms from time to time for legal, regulatory, security, technical or operational reasons.

30.2 The version applying when a Customer purchases a Product will normally govern that purchase.

30.3 We will not use a later change to these Terms simply to remove a material contractual right already purchased by an existing Customer.

30.4 Where a change must apply to an existing service for legal, regulatory or security reasons, we will take reasonable steps to communicate material changes where appropriate.

31. Transfer of rights

31.1 A Customer may not sell, assign or transfer Course access to another Student without Eureka's written agreement.

31.2 Eureka may transfer its rights and obligations to another organisation where this does not materially reduce the Customer's contractual rights and where permitted by law.

32. Severability

32.1 If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

33. No waiver

33.1 If Eureka does not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

34. Third-party rights

34.1 Unless expressly stated otherwise, a person who is not a party to the contract between Eureka and the Customer does not have a right to enforce these Terms.

35. Governing law and jurisdiction

35.1 These Terms and the contract between Eureka and the Customer are governed by the laws of England and Wales.

35.2 Subject to any mandatory consumer rights concerning jurisdiction, the courts of England and Wales will have jurisdiction over disputes arising from these Terms.

35.3 If a consumer lives outside England and Wales, they may also benefit from mandatory consumer protections or rights to bring proceedings in another jurisdiction where applicable law requires this.

Pearson Edexcel Remote Invigilation Exam Booking Terms

These Exam Booking Terms apply where a Customer asks Eureka Homeschool to arrange entry for a Pearson Edexcel examination using Pearson's Remote Invigilation service. They should be read together with Eureka Homeschool's general Terms and Conditions and all applicable Pearson Edexcel rules, candidate requirements, Remote Invigilation requirements and examination regulations.

Eureka Homeschool is a trading name of Boland Companies Ltd, company number 11744949.

1. Separate examination service

1.1 Purchasing an Eureka Homeschool Course does not include an examination entry unless expressly stated otherwise.

1.2 Course fees and examination fees are separate.

1.3 Students may normally arrange an examination independently through an appropriate examination centre.

1.4 Cambridge examinations must be arranged through an appropriate examination centre and are not covered by these Remote Invigilation Terms.

1.5 Pearson Edexcel Remote Invigilation is available only for qualifications, subjects, components, countries and examination series supported by Pearson.

1.6 Availability may change and is ultimately subject to Pearson's rules and approval.

2. Customer and Student

2.1 Where the Student is under 18, the examination booking must be made by a parent or legal guardian aged 18 or over.

2.2 An adult Student may make their own booking where permitted by Pearson's rules.

2.3 The Customer is responsible for ensuring that the Student understands and complies with all candidate requirements.

2.4 Nothing in these Terms guarantees that Pearson will accept an individual Student for Remote Invigilation.

3. Examination entry

3.1 The Customer must ensure that the correct:

a. qualification;

b. subject;

c. syllabus or specification;

d. unit or paper;

e. examination series; and

f. examination format.

3.2 Eureka may provide administrative guidance, but final responsibility for checking that an examination entry is appropriate remains with the Customer.

3.3 Eureka is not responsible for a Student being entered for the wrong examination where the error resulted from incorrect or incomplete information supplied or approved by the Customer.

3.4 The Customer must check all statements of entry and other examination documentation promptly and report any error immediately.

4. Examination fees

4.1 Examination fees are charged separately from Course fees.

4.2 The fee payable will be the fee shown when the examination booking is made.

4.3 Examination fees may include amounts payable by Eureka to Pearson or another examination-service provider together with Eureka's administration and service costs.

4.4 Payment must be made by the relevant published deadline.

4.5 An examination entry is not guaranteed merely because an enquiry or provisional request has been made.

5. Entry deadlines and late entries

5.1 Customers are responsible for completing all required booking steps and making payment before the published entry deadline.

5.2 Where Pearson permits a late entry, Eureka may accept the booking subject to availability and payment of all applicable late-entry fees.

5.3 All late-entry charges imposed by Pearson or another provider are payable by the Customer.

5.4 If an examination booking is subsequently withdrawn, whether a late-entry fee can be refunded depends upon whether Eureka is able to recover that amount from Pearson or the relevant provider and the withdrawal provisions below.

6. Published withdrawal deadline

6.1 Eureka will publish the applicable withdrawal deadline for an examination series on the relevant examination page, booking page or accompanying booking information.

6.2 The Customer is responsible for checking the withdrawal deadline that applies to the Student's examination series.

6.3 A withdrawal request is effective when it is received by Eureka at helpdesk@myonlineteachers.co.uk.

6.4 Verbal notice or notice sent only to Pearson does not constitute notice to Eureka unless Eureka confirms otherwise.

7. Withdrawal before the published deadline

7.1 Where Eureka receives a valid withdrawal request before the published withdrawal deadline, Eureka will calculate the refundable amount as follows.

7.2 Eureka may retain:

a. any examination, entry, late-entry, Remote Invigilation, provider or other fees which Eureka remains liable to pay and cannot recover from Pearson or another relevant provider; and

b. an administration fee of £50 per Student for processing the withdrawal.

7.3 The £50 administration fee is charged per Student for the relevant withdrawal, not separately for each subject included in that withdrawal request.

7.4 Subject to statutory rights, the remaining recoverable balance will be refunded to the Customer.

8. Withdrawal after the published deadline

8.1 Where a withdrawal request is received after the published withdrawal deadline, examination fees are non-refundable, except where applicable law expressly requires otherwise or Eureka confirms otherwise in writing.

8.2 This applies even where the Student later decides not to sit the examination.

8.3 Failure to attend the examination does not itself create an entitlement to a refund.

9. Pearson Terms of Use and Parent Agreement

9.1 Pearson may require the Student and/or their parent or guardian to read, sign, accept or complete Pearson Remote Invigilation agreements, Terms of Use, declarations or consent documentation.

9.2 Completion of these requirements is a condition of using Pearson Remote Invigilation where Pearson requires them.

9.3 The Customer is responsible for completing required documentation accurately and by the deadline communicated by Eureka or Pearson.

9.4 If the required Pearson documentation is not completed and this results in the Student being unable or not permitted to sit the examination, Eureka is not required to provide a voluntary refund of the examination fee.

9.5 This applies where Eureka has reasonably communicated the requirement and provided the Customer with an appropriate opportunity to complete it.

10. Mandatory familiarisation

10.1 Pearson Remote Invigilation candidates may be required to participate in mandatory technical checks, familiarisation, demonstrations, mock sessions, practice activities or other preparatory processes.

10.2 These activities are an important part of confirming that the Student understands the Remote Invigilation system and that their equipment and environment are suitable.

10.3 The Student must engage with all mandatory familiarisation requirements within the required timescale.

10.4 If the Student fails to participate appropriately in mandatory familiarisation and, as a consequence, Pearson or another authorised provider prevents the Student from sitting the live examination, the examination fee is non-refundable except where applicable law requires otherwise.

10.5 The Customer is responsible for ensuring that the Student attends and meaningfully participates in the required familiarisation process.

11. Technical and equipment requirements

11.1 Remote Invigilation depends upon the Student meeting the current technical requirements published by Pearson and/or Eureka.

11.2 The Customer is responsible for ensuring, before the examination, that the Student has all required:

a. compatible computers or devices;

b. webcams and cameras;

c. microphones and speakers;

d. required browser or software;

e. stable internet connection;

f. charging equipment and power;

g. examination workspace;

h. identification documents; and

i. any other equipment specified in the examination requirements.

11.3 Requirements may differ between onscreen and paper-based Remote Invigilation examinations.

11.4 Customers must consult the current examination requirements published on Eureka's examination pages and any instructions issued by Pearson.

11.5 Where a Student cannot sit or complete an examination because their own equipment, software, internet connection, examination environment or identification does not meet the communicated requirements, there is no automatic entitlement to a refund.

12. Examination location and environment

12.1 The Student must sit the Remote Invigilation examination from a location permitted by Pearson.

12.2 Remote Invigilation is not available in every country or territory.

12.3 The Customer must accurately disclose the Student's location where this is required for entry.

12.4 If the Student intends to sit an examination from a different country or location from that originally notified, Eureka must be told sufficiently in advance.

12.5 The Student's examination room and workspace must comply with Pearson's requirements.

12.6 A failure to provide a compliant examination environment may result in the examination being stopped or the Student being refused permission to begin.

13. Identification and personal details

13.1 Customers must provide accurate personal and candidate information.

13.2 This may include:

a. the Student's full legal name;

b. date of birth;

c. address;

d. country and location;

e. email address;

f. candidate information;

g. photographic identification; and

h. other information required by Pearson.

13.3 The Customer is responsible for checking that personal details match the Student's identification documents where required.

13.4 Customers must provide acceptable identification by any deadline communicated to them.

13.5 Eureka is not responsible for consequences caused by inaccurate information provided by the Customer.

13.6 Any amendment or additional charge imposed by Pearson as a result of Customer-supplied errors may be charged to the Customer.

14. Access arrangements

14.1 Customers seeking access arrangements must notify Eureka as early as possible.

14.2 All access arrangements are subject to the applicable Exam Board rules, evidence requirements, deadlines and approval process.

14.3 The Customer is responsible for obtaining and providing appropriate supporting evidence.

14.4 Eureka cannot guarantee that Pearson will approve a requested access arrangement.

14.5 Where available, the Customer may book a paid appointment with Eureka's SENCO to discuss access-arrangement requirements.

14.6 The SENCO appointment will normally be charged at the same then-current rate as a Private Lesson.

14.7 Payment for a SENCO appointment does not guarantee that an access arrangement will be approved.

15. Examination rules and candidate conduct

15.1 Students must comply with all Pearson, examination-security and Remote Invigilation rules.

15.2 This includes requirements relating to:

a. authorised and unauthorised materials;

b. electronic devices;

c. communication with others;

d. room and desk setup;

e. identification;

f. screen sharing and monitoring;

g. examination timings;

h. breaks;

i. submission of examination material; and

j. instructions given by authorised invigilators.

15.3 Students must behave honestly and must not attempt to cheat, obtain unauthorised assistance or compromise examination security.

16. Malpractice and disqualification

16.1 Suspected examination malpractice may be reported to Pearson or another relevant authority.

16.2 This may include:

a. impersonation;

b. receiving unauthorised assistance;

c. communicating with another person;

d. use of unauthorised notes or devices;

e. unauthorised recording;

f. attempting to copy, photograph or distribute examination material;

g. circumventing Remote Invigilation controls; or

h. other breaches of examination rules.

16.3 Pearson is responsible for decisions concerning malpractice, disqualification, invalidation of results and other examination sanctions.

16.4 Where the Student is disqualified, removed from an examination or prevented from completing an examination because of their own conduct or breach of examination rules, examination fees are non-refundable except where applicable law requires otherwise.

17. Examination dates and attendance

17.1 The Customer and Student are responsible for noting the correct examination date and start time.

17.2 International Customers must pay particular attention to the stated time zone.

17.3 The Customer must ensure that the Student is ready sufficiently early to complete all required setup and security procedures.

17.4 Failure to attend, logging in late, misreading the timetable or using the wrong time zone does not create an entitlement to a refund.

18. Technical problems during an examination

18.1 If a technical problem occurs, the Student must follow the instructions of Pearson, the invigilator and/or Eureka.

18.2 Where the problem is caused by the Student's equipment, internet connection, power, software, location or failure to meet communicated technical requirements, Eureka is not responsible for the resulting loss of examination opportunity.

18.3 Where the problem is attributable to Pearson or its Remote Invigilation provider, any rescheduling, credit or refund will normally depend upon the remedy Pearson makes available.

18.4 Where the problem is caused by a breach or failure by Eureka for which Eureka is legally responsible, Eureka will provide an appropriate remedy in accordance with applicable law.

19. Cancellation or changes by Pearson

19.1 Pearson may change, postpone, withdraw or cancel an examination, qualification, subject, component or Remote Invigilation service.

19.2 Pearson may also change countries in which Remote Invigilation is available or impose additional eligibility or technical requirements.

19.3 These decisions are outside Eureka's control.

19.4 Where Pearson cancels, postpones or prevents an examination from proceeding through no fault of Eureka, Eureka will pass on or make available to the Customer any applicable refund, credit, transfer or rescheduling remedy which Eureka receives or is permitted to provide from Pearson.

19.5 Eureka does not guarantee that Pearson will provide a full cash refund in every circumstance.

19.6 Nothing in this clause limits any statutory remedy available to the Customer against Eureka where Eureka itself has breached the Customer's contract.

20. Examination results

20.1 Examination grades and results are determined by Pearson, not Eureka.

20.2 Eureka does not guarantee any result, grade or mark.

20.3 Eureka is not responsible for marking decisions or grade boundaries determined by Pearson.

20.4 Any enquiry about results, review of marking or other post-results service is subject to Pearson's rules, fees and deadlines.

20.5 Where Eureka offers assistance with a post-results application, any applicable fees must be paid separately.

20.6 A review of marking does not guarantee that a result will increase and may be subject to the consequences specified by Pearson.

21. Certificates and digital credentials

21.1 Certificates and credentials are awarded and issued by Pearson in accordance with Pearson's current certification arrangements.

21.2 Where Pearson makes a digital certificate or credential available to an eligible Student, including through a service such as Credly, it may be issued directly by Pearson or its appointed provider.

21.3 Eligibility for a digital credential, including any applicable age requirement, is determined by Pearson and may change.

21.4 Where Eureka receives a physical certificate for onward delivery, reasonable standard postage is normally included in the examination fee.

21.5 If:

a. delivery is unavailable to the Student's country;

b. specialist or courier delivery is required; or

c. the reasonable delivery cost exceeds three times the equivalent standard UK domestic postage cost.

21.6 Eureka may require the Customer to pay an additional reasonable delivery charge before the certificate is dispatched.

21.7 Eureka is not responsible for delays in certification caused by Pearson or for postal delays genuinely outside Eureka's reasonable control.

22. Examination refunds and statutory rights

22.1 The refund provisions in these Exam Terms describe Eureka's contractual and voluntary withdrawal policy.

22.2 They do not remove any statutory cancellation or consumer right that applies to the particular transaction.

22.3 Where the Customer expressly asks Eureka to begin examination-entry or administration services during a statutory cancellation period, the Customer may be required to pay for work already properly performed where the law permits this.

22.4 Where a service has been fully performed after the legally required request, consent and acknowledgement have been provided, statutory cancellation rights may end where applicable law permits.

23. Suspension and refusal of entry

23.1 Eureka may refuse to submit, complete or maintain an examination entry where:

a. required fees have not been paid;

b. mandatory documents have not been supplied;

c. identification requirements have not been met;

d. required Pearson agreements have not been completed;

e. the Student fails mandatory familiarisation;

f. information supplied appears false or fraudulent;

g. Pearson does not approve the Student or entry; or

h. the entry would breach Pearson's rules.

23.2 Refund entitlement in these circumstances will depend on the reason for refusal, the applicable withdrawal deadline, unrecoverable third-party costs and statutory rights.

24. Personal information and examination data

24.1 In order to arrange an examination, Eureka may need to provide personal information to Pearson, Remote Invigilation providers and other organisations involved in delivering the examination.

24.2 Customers must ensure that information supplied is accurate.

24.3 Examination-related information will be processed in accordance with applicable data-protection law and the relevant privacy notices.

25. Complaints

25.1 Examination administration complaints should first be sent to helpdesk@myonlineteachers.co.uk.

25.2 We aim to acknowledge complaints within one week where reasonably possible and aim to provide a substantive resolution within one month where reasonably possible.

25.3 Where a complaint concerns a decision made by Pearson, Eureka may need to refer the Customer to Pearson's applicable process.

25.4 If the Customer remains dissatisfied with Eureka's handling of a complaint, they may escalate it to proprietor@bolandcompanies.co.uk.

26. Liability

26.1 The liability provisions in Eureka's general Terms and Conditions also apply to examination services.

26.2 In particular, Eureka is not responsible for examination outcomes or decisions made independently by Pearson.

26.3 Nothing in these Exam Terms excludes liability that cannot lawfully be excluded, including applicable statutory consumer rights.

27. Changes to examination requirements

27.1 Examination requirements may change because Pearson changes its regulations, systems, technology, deadlines or procedures.

27.2 Eureka may update these Exam Terms and its examination guidance to reflect such changes.

27.3 Customers and Students must follow the examination requirements applicable to their examination series, including updated Pearson requirements communicated before the examination.

28. Governing law and jurisdiction

28.1 These Exam Terms are governed by the laws of England and Wales.

28.2 Subject to mandatory consumer jurisdiction rights, the courts of England and Wales will have jurisdiction over disputes.
